Terms & Conditions
(Relating to the use of the EducateFirst website and any services offered/provided)
Please read the following before registering with EducateFirst.
By registering, you accept that you are entering into a contract with us based on these Terms and Conditions.
We reserve the right to make any necessary changes to these Terms and Conditions.
Important: Please ensure that you inform us of any change of details (e.g. your email address). This will ensure that
we are able to continue to contact and provide you with the services you have requested.
1. Definitions
1.1 Below is a list of "Terms" of expression together with their definitions used here, on the website and in other
materials:
l "EducateFirst" refers to the name of the company that liaises with tutors, students and/or their nominees to
provide any requested tuition and/or careers service.
l "Us", "We" or "Our" means EducateFirst.
l "Client" or "Member" in relation to EducateFirst refers to tutors, students and/or their nominees (including,
parent(s) and guardian(s)) who have registered with us for our services.
l "Student" refers to person(s) (including their nominees) requiring/requesting tuition services by a tutor.
l "Parent(s)" refers to the parent(s), guardian(s) or nominee(s) of students acting on behalf of the student to
request tuition services by a tutor.
l "Tutor" refers to a person suitably qualified and experienced to provide tuition services in specific areas of
expertise.
l "You" can refer to tutors and students (both registered and unregistered) who use our website or contact us.
l "Contract" is the period during which a tutor provides a service to the student as agreed between the tutor and
student.
1.2 In these Terms words importing the singular shall include the plural and vice versa, and words importing the
masculine gender shall include the feminine gender and vice versa.
1.3 All and any business undertaken by EducateFirst, a tutor and/or a student is transacted subject to these
Terms. In the event of any conflict between these Terms and any other terms and conditions, these Terms
shall prevail unless otherwise agreed in writing by EducateFirst
1.4 These Terms supersede all previous Terms of Business issued by EducateFirst.
2. Obligations of EducateFirst
2.1 We will take all reasonable precautions to keep the details of tutors and students secure, but will not be liable
for unauthorised access to the information provided by tutors and students.
2.2 We will liaise with both tutors and students to help provide a service to both parties.
2.3 We will be responsible for the collection of fees from the student and payment to the tutor for all services
received/provided.
2.4 We will verify the qualifications, references and CRB checks of any tutor whom enters into, or proposes to enter
into, a contract with us.
3. Obligations of a Tutor
3.1 A tutor warrants that he/she is of at least 18 years of age, has the necessary qualifications and/or experience
to provide tuition in the subjects highlighted to EducateFirst at the time of registration.
3.2 A tutor shall indemnify EducateFirst from all claim liabilities, costs and expenses (actual or consequential)
of every kind and nature known and unknown, suspected and unsuspected, disclosed and undisclosed arising
out of any use of any services we provide.
3.3 A tutor agrees with the fees (hourly rates) and, if applicable, any associated charges set by EducateFirst for
the different levels and types of services the tutor will provide a student.
3.4 A tutor will not discuss any fees (charged or outstanding) with the student.
3.5 A tutor must not demand or accept any form of payment from the student. All payments from both tutor and
student are agreed and handled by EducateFirst.
3.6 A tutor will abide by the contract at all times and either arrange via EducateFirst or inform EducateFirst of
future tuition for a current or new student. Tuition outside of a contract is not permitted.
3.7 A tutor must inform EducateFirst of any new leads (tuition or other educational services work) resulting from
any contract related directly or indirectly to EducateFirst. Any additional educational service to members must
be arranged via EducateFirst.
3.8 Upon receiving your contract, a tutor must contact the student or his/her nominee within 24 hours to confirm
details and requirements.
3.9 A tutor must sign and return to EducateFirst any contractual agreement(s) before commencing tuition.
3.10 A tutor must complete and have signed (by the student or his/her nominee) each week the timesheet provided
by EducateFirst. The timesheet must be submitted to us by the 5th day of the following month to ensure that
payments are made in a timely manner. Payment will be made to your account by BACS. Please ensure you
have completed a BACS form prior to your first lesson.
3.11 A tutor is responsible for informing the student and EducateFirst of any periods where tuition cannot take place.
This includes illness, holidays and other periods of absence. Please give a minimum of 24 hours' notice
(except in unforeseeable situations). Cancellation of contracted tuition lessons or other services without due
notice may be subjected to an administration charge at the discretion of EducateFirst.
3.12 A tutor acknowledges that he/she is not an employee of EducateFirst and accepts full responsibility for all
Income Tax, National Insurance and other liabilities payable in relation to any fees/payments generated by a
contract.
3.13 During the registration process and at any other time, a tutor must provide EducateFirst with accurate and
current information about him/herself, including his/her correct name, address, telephone number,
qualifications and any other requested details. The tutor must inform EducateFirst of any change to
their personal details.
3.14 A tutor understands that EducateFirst has the right to suspend or terminate any membership at any time if,
in our view, there has been a breach of the contract, abuse of our services or the brining of our services into
disrepute.
4. Obligations of a Student
4.1 During the registration process and at any other time, a student must provide EducateFirst with accurate and
current information about him/herself, including his/her correct name, address, telephone number, educational
requirements and any other requested details.
4.2 For a one-off tuition lesson, a student agrees to pay the agreed fee to EducateFirst in advance of the lesson.
For continued tuition contract, the student agrees to pay the agreed fees on a monthly basis - all fees must
reach EducateFirst in advance of your first lesson to ensure you receive the service you require.
4.3 A student is responsible for payment of fees to EducateFirst and not to the tutor. Where a payment is not
made within 30 days of the requested date, we reserve the right to terminate your membership and cease any
further services. Late payments may be subject to an interest charge at the Bank of England base rate plus 8%
as recommended by the Late Payment legislation for small businesses. Continued failure to pay fees will result
in legal proceedings, the costs/fees for which will also be charged to you.
4.4 A student must not discuss fees and/or any other charges with the tutor.
4.5 A student must not seek, receive or accept tuition from the contracted tutor or any other tutor who is a member
of EducateFirst without prior agreement with EducateFirst.
4.6 By registering to use our services, a student acknowledges that individual tutors may have different teaching
methods and styles, and that although tutors are selected by, they are not trained by EducateFirst.
4.7 A student acknowledges that EducateFirst is not responsible for the tutor's performance nor the outcome
of the tuition and/or other services the student receives.
4.8 A student shall indemnify EducateFirst in relation to any liability arising from a student's use of the website,
tutoring and/or other services and all matters arising from such use.
4.9 A tutor cannot be held responsible for childminding, guarding a house and household effects during tutoring.
It is the responsibility of the student and/or nominee to ensure that a responsible adult is on the premises at
all times.
4.10 A student is responsible for informing the tutor and EducateFirst of any periods where tuition cannot take place.
This includes illness, holidays and other periods of absence. Please give a minimum of 24 hours' notice
(except in unforeseeable situations). Cancellation of contracted tuition lessons or other services without due
notice may result in you still being charged at the agreed hourly rate.
4.11 A student must give at least 7 days notice in writing both to the tutor and to EducateFirst should he/she no
longer require tuition. This will allow the tutor to plan and/or complete his/her work with the student as well
as plan his/her own commitments. Students may either e-mail or post their notice to EducateFirst.
4.12 A student understands that EducateFirst has the right to suspend or terminate any membership at any time if,
in our view, there has been a breach of the contract, abuse of our services or the brining of our services into
disrepute.
5 Miscellaneous
5.1 Members and non-members acknowledge that any details provided during feedback on our website is subject
to review by us. We reserve the right to monitor and edit, modify, accept or reject any comments that we feel
are inappropriate. Members and non-members also acknowledge that their name and email address may be
displayed alongside their comments/feedback on our website.
5.2 No member or non-member may use the website and/or our services for unlawful or prohibited purposes,
including the posting of false information onto the website, copying the whole (or part) of the contents for
other use, either personal or commercial.
5.3 Members agree not to impersonate any other person or entity or to use a false name or a name that they have
no authority to use.
5.4 Members acknowledge that EducateFirst is unable to guarantee that the website is free of viruses worms or
any other form of harmful components.
5.5 The code, brand, brand name, logo and intellectual property of the EducateFirst website and any related
materials cannot be reused without written permission from EducateFirst.
5.6 You are solely responsible for the submission of any materials to EducateFirst. We cannot be held responsible
for any copyright material that you may submit.
5.7 By providing us with your details and or other information, you agree that we may hold this information on our
database. With the exception of your appointed tutor/student, we will not pass on your personal details to any
third party without your consent.
5.8 EducateFirst does not guarantee to find a suitable tutor for a student, or a suitable student for a tutor. Finding
suitable tutor/student can take several weeks.
5.9 EducateFirst will search for a suitable tutor in your area; however, if a local tutor is not available, a small charge
of 30 pence per mile may be requested to cover the tutor's travel costs. This will be agreed in advance of the first
lesson. There will be no hidden charges.
5.10 You agree to indemnify us against all liabilities, claims and expenses that may arise from any breach of these
Terms and Conditions by you or through a machine on which you access our services.
5.11 Tutors and students must ensure that they are authorised to use any credit card, bank account or other monies
that are used to pay EducateFirst for the provision of their services. You are also responsible to ensure that
you and/or your bank account has sufficient funds to pay for the services you have requested from us.
EducateFirst will not be responsible for any loss/damaged however caused.
5.12 EducateFirst reserve the right to withdraw its website and/or services or modify aspects of the website/service
for any legal or commercial reasons.
5.13 In the event of our website being unavailable, we will do our utmost to ensure the service is up and running as
soon as possible. However, claims for loss or damages of any nature may be made against EducateFirst.
5.14 If you have any concerns regarding the content or use of our website and/or any materials related to
EducateFirst, then please contact us and we will be happy to look into and resolve the matter at our earliest
convenience.
5.15 EducateFirst is not responsible for any third party sites that link to our website.
5.16 Your agree to release EducateFirst and any directors, managers and employees of any liability through the
use of our services (direct or indirect).
